This AI Features Addendum (the “Addendum”) is a contract between you (the “Customer”) and Sparky AI, Inc. d/b/a ArchetypeID, a Georgia corporation with offices at 235 Mitchell St. SW, Atlanta, GA 30303 (“we”, “us”, “our”, and “ArchetypeID”) and applies to your access to and use of the AI Features within our platform.

“AI Features” means any tools, features, or functionality in the Services that utilize machine learning models, foundational large language models, or our proprietary Virtual Twins and Behavioral Swarm Engines. This Addendum supplements the ArchetypeID Master Services Agreement (MSA) or Terms of Service.

1. Use of AI Features.

Your use of any AI Features is subject to this Addendum and your governing MSA. You understand, acknowledge, and agree that certain AI Features are hosted and provided using enterprise-tier Third-Party Services (e.g., Anthropic, Google Vertex AI). The AI Features may not be available in all regions or jurisdictions, and availability may change over time. ArchetypeID is not responsible for any inaccuracies, errors, biases, or limitations in the Output or the underlying algorithms.

2. Ownership & Model Training.

  • Customer Ownership: To the extent allowed under applicable law, and as between you and ArchetypeID, both the content that you or your Authorized Users input to be processed by the AI Features (“Inputs”), and any content generated and returned by the AI Features based on such Input (“Outputs”), is your Customer Property.
  • Output Similarity: You acknowledge that due to the probabilistic nature of large language models and machine learning, the AI Features may generate the same or similar outputs for other ArchetypeID customers or users.
  • Model Training License: As explicitly set forth in your governing MSA or Terms of Service, ArchetypeID does not use your confidential, identifiable Customer Property to train our machine learning models. However, ArchetypeID retains the right to utilize strictly aggregated and de-identified usage data and inputs to train, fine-tune, and improve our proprietary artificial intelligence models and behavioral methodologies, provided such data cannot be linked to you, your users, or your confidential intellectual property. We do not permit our third-party foundational model providers to use your data to train their generalized models.

3. Restrictions on Use

You understand and agree that your use of the AI Features is strictly governed by the ArchetypeID Acceptable Use Policy (AUP), available at https://archetypeid.ai/legal/aup. In addition to the restrictions therein, you will not: (a) generate content that can inflict harm on individuals or society, or that is intentionally deceptive and likely to adversely affect the public interest; (b) mislead any person or imply that Outputs are unique or solely human-generated; (c) attempt to discover or exfiltrate any underlying components of the models, algorithms, weights, or systems; or (d) use the AI Features to develop, train, or fine-tune any competing foundational or secondary artificial intelligence models.

4. Product Research (Alpha / Beta).

You understand, acknowledge, and agree that certain AI Features may be the subject of Product Research (marked as “Alpha” or “Beta”). As such, these experimental AI Features are currently offered “AS IS,” warranty-free, and at no additional cost. You understand that this is subject to change at any time in ArchetypeID’s sole discretion. For example, use of certain AI Features may become subject to usage limits or fees, or ArchetypeID may discontinue, disable, or degrade access to certain AI Features in its sole discretion.

5. Customer Responsibilities & Disclaimers.

Artificial intelligence, large language models, and machine learning technologies have known and unknown risks and limitations, including that content generated by such technologies is subject to inaccuracies, “hallucinations,” biases, and other defects. ArchetypeID makes no representations, warranties, or covenants of any kind regarding the Outputs or the Third-Party Services that support the AI Features. Outputs are probabilistic computational models and do not constitute absolute factual guarantees, nor professional, financial, or legal advice. You are solely responsible for reviewing any Outputs prior to acceptance, market deployment, or reliance thereon, and for developing your own internal policies regarding the appropriate use of such technologies by your Authorized Users.
